Following is our determination:
The Division's provided information amends responses to violations 1
and 2 of 2 as now appropriate. Although the county has resumed
responsibility for the haul road, contradiction with Federal Register
Volume 51, No. 224, November 20, 1986 may still exist. This should be
considered a programmatic issue for future discussion.
In summary, the Division's response to violations 1 and 2 of 2 is now
considered appropriate. Please address any questions concerning this
determination to Steve Rathbun, Supervisory Reclamation Specialist, at
(505) 766-1486.
Sincerely,
/~
~~Ro ert H.
