Long <br />Division Director <br />Division of Minerals <br />1313 Sherman Street <br />Denver CO 80203 <br />o~r`~IVED <br />December 15, 1995 DEC ~g 1995 <br />C4RT # p r ~(o - 338' 3 8 7 <br />Divisron of Mmerais a Ueology <br />and Geology <br />RE: Possible Violation, Moffat County, Refuge Pit <br />No. M-89--112 <br />Dear Mr. Long: <br />This letter is in response to the allegation of <br />"possible violation" in the above referenced Refuge Pit No. <br />M-89-112 as noted in your certified letter of 12/1/95 and <br />in the enclosed inspection report dated 10/24/95 by Carl Mount <br />and Andy Moore. <br />I will respond to the "Observations" in order: <br />Observation_#1: Moffat County will seed the existing <br />topsoil and overburden stockpiles in the spring of 1996 <br />with our approved seed mix formula; <br />Observation #2: The materials that barely encroach the boundary <br />line are of little consequence. The entire area surrounding <br />this pit was previously disturbed and never reclaimed. <br />It is Moffat County's policy to reclaim adjoining and <br />prior disturbed areas on BLM to their guidance and <br />satisfaction; <br />Observation_#3: This is a false allegation! In 1989 <br />There existed a neiwo;•k cf access ids ...rC',:nd'.^.g this <br />pit. The road to the northeast, east andysoutheast is shown <br />on the enclosed 1973 aerial photograph. Moffat County <br />did not reestablish this road. We bladed off the weeds <br />for fire control and used it as it existed prior to <br />this permit. (see definition of "affected land" Rule 1 <br />CRS 34-32-103(1) on page #1 of the Mineral Rules and <br />Regulations revised November, 1988) <br />ROAD SUPERVISOR <br />P.0.
