Commodity: Sand & Gravel <br />Operator: Same County: Adatns <br />Existing Bond: X730,400.00 Adequate?: 1'ES <br />Method of Mining: Surface Specialist: Erica Crosby <br />NATURE OF VIOLATION(S) (Describe the activity) <br />~. <br />On February ] 3, 2002 and February 14, 2002 the Division received citizen complaint ]esters from Rick Anderson <br />of Adams County and Nancy Borcleau Love of Love & Associates stating that tnining was taking place outside of <br />the approved mining limits of the Nyho]t/Mann Lake Mine. The Division inspected the site on February 27, 2002 <br />and observed a newly reclaimed pit closer than 200 feet to the Branter Ditch. <br />A survey of the azea, conducted b}' the Applegate Group, depicts the mining/reclamation distance between the edge <br />of the southern pit to the centerline of the Branter Ditch is between 164 and 220 feet. The approved map titled, <br />Mining Plan and Affected Lands Exhibit C (dated 6-22-88), notes the approved limit of mining to be a distance of <br />275 feet [0 350 feet from the edge of the pit to the centerline of the ditch. The map titled, Reclamation Plan Exhibit <br />F (dated 6-22-88), depicts reclamation to be established a distance of 300 feet to 550 feet from the edge of the pit <br />to the centerline of the ditch. <br />SERIOUSNESS <br />Administrative, describe - None <br />Onsite damage, describe - No noted datnage to the Branter Ditch was observed during the February 27, 2002 <br />inspection. <br />Offsite damage, describe - None <br />Health or safety hazazd, describe -None <br />STATUTE(S) VIOLATED AND DESCRIPTION <br />Failure to perform the reclamation prescribed by the mining and reclamation plan, a possible violation of <br />C.R.S. 34-32.5-116(1) of the CoYorado Land Reclamation Act for the Extraction of Construction <br />Materials <br />
