The NOV was issued on April 12, 1999 for failure to pass mine water discharge through a
treatment facility, failure to conduct underground mining operations as described in the approved
PHC in the permit, and failure to prevent violation of federal water quality effluent limitations.
The operator submitted water analysis that demonstrates the discharged water did not meet federal
effluent limitations. Discharge flows to Fish Creek.
3/17/99: Twentymile Coal Company called DMG of a waterline break at the Fish Creek
Borehole. Twentymile Coal Company informed us that they did not think that
water had entered Fish Creek, but that water had appeared to be seeping through
the toe of the betm of an SAE. Twentymile Coal Company indicated they had shut
off pumps and they collected water samples.
Subsequently, DMG decided to wait to inspect until we receive the water sample
analyses.
3/23/99: Twentymile Coal Company called DMG to inform us that the Fish Creek Borehole
pump was turned on 3/22/99. Twentymile Coal Company discovered a water line
leak on the morning of 3/23/99. Twentymile Coal Company infotmed DMG that a
breach in the SAE berm had occurred, indicating dischazge of mine water into Fish
Creek. Twentymile Coal Company stated that they had taken another water
sample.
3/30/99: In discussions with Twentymile Coal Company, DMG was informed of a third
waterline leak that had occurred on 3/30/99. Twentymile Coal Company stated
that this leak flowed to a different SAE, and had not flowed to Fish Creek.
4/1/99: DMG conducts an inspection of the Twentymile Coal Company Fish Creek
Borehole site. Pump was turned off. Twentymile Coal Company was repairing
the waterline. Discharge from the treatment ponds was occurring. DMG sampled
NPDES pt. 001 discharge, and Fish Creek upstream and downstream of the
permitted discharge. The waterline breaks mentioned previously had been
repaired.
Twentymile Coal Company gave a copy of the 3/17/99 spill water analyses results
at the end of the inspection.
4/6/99: Twentymile Coal Company met with DMG in Denver regarding other permitting
actions. Twentymile Coal Company provided DMG a copy of the 3/23/99 spill
water analyses results at this meeting.
4/9/99: DMG faxed a copy of the violation to Twentymile Coal Company.
4/12/99: DMG conducted a complete inspection of Foidel Creek Mine and hand delivers
NOV.
