Mr. Kay's letter was written in response to the
Division's February 14, 1994 request for a review by the Deputy
Director of the Division's December 20, 1993 response to AFO
regarding Ten-Day Notice No. X-93-020-370-005 TV 3.
In his letter, Mr. Kay granted the Division until July 25, 1994 an
opportunity to complete its investigation regarding this Ten-Day
Notice. On July 11, 1994, personnel from the Division revisited
the windmill well and property owned by Mr. Jim Tatum of Houston,
Texas. According to Mr. Tatum in his letter of November 30, 1993
to AFO, his well was "now quite dry" due to mining operations
conducted by Basin Resources, Inc. at their Golden Eagle Mine in
Las Animas County, Colorado. It was this letter that formed the
basis for AFO issuing this Ten-Day Notice.
During the Division's inspection of July 11, 1994, Division
personnel were accompanied by Mr. Tatum. At the time of the
inspection, the Division was able to demonstrate to Mr. Tatum that
water in fact existed in his well. On July 12, 1994, Mr. Tatum
wrote a letter to the Division stating that, "it appears that the
well that we thought was dry does have 40-plus feet of water in the
borehole...It would appear at this point that the airshaft has not
harmed the well, unless the flow of water into the well bore has
been decreased to the point the well will not produce a usable
quantity of water" (copy of letter enclosed).
In light of Mr. Tatum's recent letter, the Division believes the
issue raised by Mr. Tatum in his November 1993 letter to AFO
regarding a lack of water in his well has been resolved. As this
concern was the final item remaining to completely address this
