Mining has occurred outside permit boundaries as described in Exhibit A of <br />Permit No. M-80-146. <br />2. Sufficient material to backfill the pit highwalls to a 3H:1V slopes, as <br />required by Exhibit E of Permit No. M-80-146, was not evident. <br />3. Off-site erosion was observed on BLM land. The erosion cannot be <br />controlled until the highwall has been backfilled as described in Exhibit E of <br />Permit No. M-80-146. <br />We believe this is in violation of: Exhibits A and E of Permit No. M-80-146 <br />and CRS, 1973 34-32-116(1)(1). <br />Therefore, we have found reason to believe a violation exists to Permit <br />M-80-146 and the Law and have scheduled this matter before the Mined Land <br />Reclamation Board. <br />A Formal Public Hearing will be held during the March 20, 1986, Board <br />meeting for consideration of possible violation. The hearing will be held at <br />the Quality Inn, Highway 50 Dozier Avenue, Canon City, Colorado, beginning at <br />8:00 a.m. or as soon thereafter as the matter can be considered and you will <br />have the opportunity to be represented and heard. It will be reiterated that <br />there is reason to believe that you are in violation of the provisions noted <br />above. <br />If the Board finds a violation at this hearing, it may issue a cease and <br />desist order, assess a civil penalty in the amount of 550.00-5200.00 for each <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
