Mining has occurred outside permit boundaries as described in Exhibit A of
Permit No. M-80-146.
2. Sufficient material to backfill the pit highwalls to a 3H:1V slopes, as
required by Exhibit E of Permit No. M-80-146, was not evident.
3. Off-site erosion was observed on BLM land. The erosion cannot be
controlled until the highwall has been backfilled as described in Exhibit E of
Permit No. M-80-146.
We believe this is in violation of: Exhibits A and E of Permit No. M-80-146
and CRS, 1973 34-32-116(1)(1).
Therefore, we have found reason to believe a violation exists to Permit
M-80-146 and the Law and have scheduled this matter before the Mined Land
Reclamation Board.
A Formal Public Hearing will be held during the March 20, 1986, Board
meeting for consideration of possible violation. The hearing will be held at
the Quality Inn, Highway 50 Dozier Avenue, Canon City, Colorado, beginning at
8:00 a.m. or as soon thereafter as the matter can be considered and you will
have the opportunity to be represented and heard. It will be reiterated that
there is reason to believe that you are in violation of the provisions noted
above.
If the Board finds a violation at this hearing, it may issue a cease and
desist order, assess a civil penalty in the amount of 550.00-5200.00 for each
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
