The Division contends that the Bear Creek <br />reclamation plan does not comply with Rules 2.05.4(2)(c), 2.06.5(2) <br />and 4.14.1(2)(a). In particular the Division states the plan may <br />not properly demonstrate that all available spoil will be utilized <br />in reclaiming the Bear Creek Portal Area. The following discussion <br />presents Somerset's position on the ten day notice: <br />Rule 1.04(58) defines a highwall as the face of overburden and coal <br />for entry to underground mining operations. It is Somerset's <br />position that; 1) there is not a highwall at the Bear Creek <br />facilities and; 2) there will not be a highwall at the Bear Creek <br />facilities after reclamation. Therefore, the provisions of Rule <br />4.14.1(2)(a) regarding the use of all reasonably available spoil to <br />reclaim a highwall is not applicable. A demonstration that all <br />available spoil will be utilized in reclaiming the Bear Creek <br />Portal Area should therefore not be required. The Division should <br />be able to approve the reclamation plan for the Bear Creek <br />facilities if the provisions of Rule 2.06.5(2) are satisfied. <br />Following is a discussion of this rule: <br />Rule 2.06.5(21 <br />(2) Variance from original contours can be granted if: <br />(a) The applicant has demonstrated that the purpose of the <br />variance is to make the lands to be affected within the permit <br />area suitable for ..... a public use postmining land use. <br />The purpose of the variance is to make the reclaimed <br />portal area suitable for the postmining land use of <br />public use.
