Long <br />741 Main Street Division Direcor <br />Springfield, Colorado 81073 <br />RE: Adequacy Review for Baca County Pit Number 7 Conversion of a 110 Permit to 112, Permit <br />Number M-77-484: Response to Submittal Received September 10 2001 <br />Dear Mr. Crane: <br />The Division of Minerals and Geology has completed its review of your response to adequacy questions for <br />the Baca County Pit Number 7 conversion from 110 construction materials permit to a 112 construction <br />materials permit. The application was received on May 18, 2001 and determined [o be complete for technical <br />review on June 18, 2001. An Adequacy Letter was sent to you on August 14, 200 L, and this Letter addresses <br />items that require clarification in your response received September 10, 2001. The decision date for this <br />application is September 17, 2001. Please be advised that if you are unable to satisfactorily address the <br />concerns identified in this review prior to the decision date, it will be your responsibility to request an <br />extension of the review period. If there are outstanding issues that have not been adequately addressed prior <br />to the end of the review period, and no extension has been requested, the Division will deny this application. <br />The following items require further information or clarification: <br />Permit Application, Page 2, Item 9, Location Information: The Township and Range have been <br />changed from the correct location on the original application (T 30 S and R 48 W) to Township 30 <br />North and Range 48 East on this revision. Please re-submit this page with the correct township and <br />range directions. <br />6.4.1 Exhibit A Legal Description: The legal description submitted in the original submittal as <br />Exhibit A, appears [o represent the area being proposed [o be mined. The new Exhibit A received in <br />this office on September 10, 2001 describes an 80 acre parcel some of which is not [o be mined <br />according to the map Exhibit C(a). The application indicates [he permit area to be 160 acres. Please <br />indicate in a revised submittal what area you wish to permit. This area must agree with the various <br />maps and with Exhibit N, Source of Legal Right to Enter. Please call me and I will be happy to assist <br />in the description. <br />ti.4.3(a) Exhibit C Adioining Surface Owners: You have indicated that Lomax Partnership owns <br />the property to the south of the mining operation. You have obviously notified him, as he has <br />contacted [he Division and reviewed your permit file in our office. He has indicated to [his inspector <br />that he has no objection to your permit application. We do need a copy of the registered mail receipts <br />to make the permit file complete. <br />
