As the Division has specified during the review of CN-001, the conversion from <br />a DMO operation to a non-DMO operation cannot take effect until the cyanide contaminated material <br />located on the Neglected Mine site is removed or detoxified. Therefore CN-001 is approved with <br />the following stipulation: <br />The conversion to a non-DMO operation will not take effect until the cyanide heap leach pad <br />material has been proven, by adequate analysis of the material, to be detoxified. If not <br />complied with by October 2, 1996, the CN-001 approval will be recinded, the Neglected <br />Mine will remain classified as a DMO operation, and compliance with all Rules applying to <br />DMO operations will be required of Mine Development, Inc. <br />If MDI does not agree with this stipulation, they must respond to this letter by April 15, 1996 with <br />reasons why the stipulation is unacceptable, and with alternative proposals.
