ednesday, November 29, 2000 04:52:52 AM III IIIIIIIIIIIII III
999
Jim & Maggie Freeman
5751 North County Road 27
Loveland, CO R053R
To: Erica Crosby
Re: conceming expansion permit for Glenn Southwick
Hi F..rica:
I am sending you this fax to put into writing rm' complaint about the proposed expansion of the
Glenn Southwick Mason Stone Company Quarry. We have discussed the matter with all of the
etTecled properly owners that will be negatively elI'ected by the proposed expansion. They have
agreed to write letters of complaint to ~Ir. Carl Mount.
I want to complain that bor. Southwick is working in his quarry on any day of week and at any
time of the day,. The law requires that his over burden shall not come with 50' of adjacent
properties to his quarty. Sense Mr. Southwick does not follow the rules conceming the
management of his over burden, the proposed expansion will negatively effeM my property which
adjacent to his quan}'. )\1r. Oakely who lives on County Road 29 has complained several times
to the county conceming Mr.
Southwiek's inability to properly manage his over burden of where Mr. Oakley lives. ht tact, Mr.
Southwiek's miss management has had a negative ctTect on a small creek called 1\lissouri C'reck
in that the over burden has come close to damming the creek. From what hir. Southwick indicated
to both myself and to Mr. Oakley, that he intends to expand the quarry such that is will almost
encompass [he entire 2R acres of which he owns. The stipulation of the quanq at the time that my
father sold the propem' to Mr. Southwick was that the quam' was not to increase in size. I cannot
understand the logic that rewards someone for violating the ndes by awarding him a larger area by
which he can quarry.
If the State of Colorado approves the proposed expansion of Mr. Southwiek's Quarry. I will not
only be ablz to see the effects, but my health will bz degraded due to the diseased that I have. I am
attaching a letter from my doctor stating gym- condition and basically saying that open pit mining
will have a negative effect on my health. I am present{y on a Social Security Disability because
oftlu illness and had to retire from Hewlett Packard because of bad health.
When this expansion was made know to me t ryas told that we, as adjaxnt property owners, were
given little to no time to register our concerns and complaints. Sense klr. Southwick had broken
the lacy, it would be yen' appropriate to insist that Ddr. Southwick go through the estahlished
procedure for obtaining the expansion to his quam'.
Again, 1 do not wtderstand how someone echo lutowingh' breaks the law can be rewarded by giving
an expansion to ltis present quarry site. It appears that the present Mining Laws of the State of
Colorado have no real effect.
Sincerely yours,
,iim Freeman
see attachment;
