Cattany <br />Durango, CO 81302-2707 Division DIfeC10r <br />Natural Resource Trustee <br />Re: Cugnini Gravel Pit, Amendment Approval, Permit No. M-1986-061, Revision No. AM-1 <br />Dear Ms. Talvitie: <br />On December 30, 2004 the Division of Minerals and Geology approved the Amendment application submitted to the <br />Division on May 6, 2004, addressing the following: <br />Expandpermit acreage; revise miningplan for aphased operation; reject material to be used for filling natural <br />gulches; and improvedrunojfcontrol-structures. <br />The terms of the Amendment No. I approved by the Division are hereby incorporated into Permit No. M-1986-061. <br />The conditions of the Division approval aze noted below. Please note that all other provisions of Permit No. M-1986-061 <br />remain in full force and effect. <br />Stipulation No. Description <br />2. OPERATION MAY NOT ENCROACH ANY CLOSER TO THE GAS WELL UNTIL SUCH <br />TIME THAT A DAMAGE AGREEMENT HAS BEEN APPROVED BY DMG. <br />The estimated liability amount the Cugnini Gravel Pit, under this amended plan, is $61,966.00 less than the existing <br />liability amount of $177,293.00 that is currently posted. As such, you may reduce your posted bond by submitting a <br />replacement bond or a rider to the existing bond, in the new amount of $115,327.00.
