The Division has reviewed your responses. Below aze listed items that require further <br />response or clarification. The item numbers are the same as those used for the initial review. If an item number <br />listed in the initial review does not appeaz in the list you may assume your response was adequate. By regulation, the <br />Division must make a decision (recommendation to the Mined Land Reclamation Board) on your applicafion by <br />June 12, 2003. A final decision on your application will be made by the Board, on June 25, 2003, during a Formal <br />Public Hearing. Please provide your responses to these items by 5:00 pm June 11, 2003, so the Division can <br />consider them in making it's recommendation. If you aze unable to fully respond to this letter and need more time to <br />prepare your responses, please contact me requesting continuance of Division consideration to a later date. <br />Please be advised that your application may be deemed inadequate and a recommendaton for denial maybe made <br />on June 12, 2003, unless the following adequacy review items are addressed to the satisfaction of the Division. <br />Exhibit C -Pre-Mining and Mining Plan Maps of Affected Land <br />4. This item asked that the amendment boundary and affected land boundary be shown with different map <br />symbols. It also stated [hat the amendment boundary symbol could be shown where the two boundaries aze <br />the same. After the Pre-Hearing Conference, I discussed this item with you and Mike Refet. You both <br />agreed that land could be disturbed to the amendment boundary under your proposed application and that <br />the amendment and affected land boundaries aze the same. Please provide new maps adding "and <br />Boundary of Affected Land" to the legend symbol for Boundary of Amendment No. 1 Area. <br />Exhibit D -Mining Plan <br />10. Your response to this item includes the statement "No dewatering shall be undertaken, until either an <br />agreement is made with the owners of all wells within 600 ft. or the Stale Engineer's Office (SEO) <br />approves partial de-watering."
