DA NIELSON <br />III III III III IIII III <br />999 <br />4, T9S, R67W <br />As requested, we have reviewed the above referenced application for a <br />permit to mine sand and gravel on 139 acres, 5 miles south of Castle Rock, <br />Colorado in Douglas County. The application states that ground and surface <br />waters will not be affected. Further, the Reclamation Plan shows no permanent <br />ponds to be created. Approximately 25 acre-feet of water will be required <br />each year for washing operations and dust suppression. This water will be <br />supplied through an agreement with the landowner. The applicant should make <br />certain that the water supplied by the applicant has been decreed for <br />industrial or commercial use. <br />The location of this operation along East Plum Creek and the depth of <br />mining (25 to 30 feet) would indicate there is a strong possibility that <br />ground water will be exposed. If ground water is exposed and put to <br />beneficial use, then a well permit would be required. Otherwise, the <br />applicant will be in violation of C.R.S. 37-90-137. Since the mining <br />operation is located in an over-appropriated basin, the well permit could not <br />be obtained until a court approved plan for augmentation has been developed. <br />As long as the mining operation will not expose any ground water and a <br />legal water supply source will be used to supply water for the project, we <br />have no problems with this application. However, if our Water Commissioner <br />determines that ground water is being exposed or pumped out without a well <br />permit, we will order the Asphalt Paving Company to cease operations. <br />HDS/JCM:ma/5350H <br />cc: Alan Berryman, Div.
