Cattany <br />RE: Seneca II-W Mine (Permit No. C-1982-057) Division DirecTOr <br />TR-49 Remaining Adequacy Issues Natural Resource Trustee <br />Dear Mr. Karo: <br />We have reviewed the information submitted in your response package of March 23, 2005, <br />on the remaining TR-49 adequacy items (2 and 5), and we find the responses to be <br />satisfactory. With respect to Item No. 2, we believe the circular failure analysis, which <br />indicated a factor of safety of less than 1.3, may be more appropriate than the block failure <br />analysis, which indicated a factor of safety in excess of 1.3. However, based on the <br />factors discussed in your letter and the stability analysis attachment, we will not require <br />further analysis or slope reduction at this time. Re-evaluation will be required if there is <br />future evidence of instability. <br />Regarding Item No. 2, we acknowledge and concur with the decision to submit the "as- <br />built" report for the two pond 016/016A system within the PR-5 application, rather than the <br />TR-50 application. <br />We have no further review comments, and we will proceed with issuance of a proposed <br />decision to approve TR-49.
