Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division received your second adequacy response comments on February 26, 2007 regarding the <br />Conversion Application (CN-Ol) for the Colorado Marble, L.L.C. Lilly Mines, Permit No. M-1987-028. <br />The Division has the following items that need to be addressed prior to approval of the application. <br />1. The operator states that the permit will be transferred from Colorado Marble LLC to Colorado <br />Mazble Inc. The Division has not received the necessary paperwork in order to transfer the <br />permit. Please be aware that the transfer must be approved prior to the approval of the <br />Conversion Application. <br />2. The operator states that the 0.25 acre of disturbed ground located within the Shamrock Claim was <br />reclaimed to original conditions in 2006. Colorado Mazble sent a letter to US Lime requesting <br />their approval of this action and requested a formal statement to that affect. Please forward the <br />referenced letters to the Division for our files. <br />3. The Division received a letter dated January 29, 2007 from the USFS regazding the relocated <br />access road and the load ouUstaging area (attached). The letter states that the USFS will not <br />allow the operator to store trucks, equipment or material in that area in excess of 24 hours. <br />Currently the permit does not contain the restrictions put forth by the USFS. Please revise the <br />permit accordingly to address the restrictions on the storage of trucks, equipment and material in <br />the load ouUstaging area. <br />4. The Division's engineering staff have reviewed the February 23, 2007 Applicant's submittal <br />responding to the Division's geotechnical adequacy review memo dated January 30, 2007. The <br />remaining and pending issue that remains is that the Applicant must provide for review a revised <br />reclamation plan map sufficient to illustrate reclaimed topography in sufficient detail to portray <br />the direction and rate of slope of all reclaimed lands with a contour interval sufficient to show <br />details of the final benches and waste dump configurations. Please provide these maps. <br />5. The Applicant has committed to conduct a permeation test in the lower pit area in the spring or <br />early summer of 2007; further revisions to the permit may be required pending the results of this <br />[est.
