Cattany, Director t)f , fF8 ~ 22~~~ <br />Colorado Division of Reclamation Minin & Safe v~sl°" °rRec~a <br />1313 Sherman Street, Room 215 g ty Mme"g a"d Sa ery1On' <br />Denver, CO 80203 <br />(303)866-3567 (v) <br />(303) 832-8106 (fx) <br />Dear Mr. Cattany: <br />This letter is to serve as notice that the Rio Culebra Agricultural <br />Cooperative, hereafter called RCAC, objects to the proposed Permit Amendment, <br />DRMS Permit No. M-88-112, recently filed by Battle Mountain Gold. <br />We dispute the supposition that the Mined Land Reclamation Board has <br />authority to grant Battle Mountain Gold water rights to irrigate its recently <br />acquired property, previously called the Shalom Ranch. We assert that the <br />MLRB cannot grant a change of industrial/mining water to agriculture use. <br />RCAC also contests the assertion by Battle Mountain Gold that the West <br />Pit water is now of pre-mining quality. Only an independent water quality <br />tests} can confirm or deny that assertion. <br />Further, RCAC objects to the proposed irrigation of the BMG property, <br />aka Shalom Ranch, with water that should have been processed through the <br />water treatment plant that is currently in operation and returned to the Rito Seco. <br />Sincerely, <br />r~~~~ <br />Ryan Rose <br />Project Manager <br />
