Jenkins Site Permit M-77-393 <br />to Response to the Informal Conference of Friday 14 July 1995. <br />Il <br />12 Dear Mr. Humphries: <br />13 <br />la As specified under Rule 1.4.6 of the Rules and Regulations as administered by <br />Is the Colorado Division of Minerals and Geology [the Division], Offi~:e of Mined <br />I6 Land Reclamation [the Office], we are providing written comments in support of <br />17 the above mentioned Technical Revision [TR]. We trust the following will better <br />]s clarify the position of Varra Companies, Inc. [Varra] respective to any and all <br />19 issues and objections raised by the City of Boulder relative to this matter. <br />zo <br />21 Contrary to statements made by officers of the City of Boulder [the City], Varra <br />22 would like to express its confidence in the good faith and professionalism of the <br />z3 Office staff and the Mined Land Reclamation Board [the Boarci]. Varra's <br />2a successful attempts to meet every deadline imposed by the Office, to perform <br />2s the more expensive task of reclamation [instead of merely covering the site <br />zb with warranty], and our continued effort to assure all concerned that a <br />27 reasoned and prudent effort is being made to comply with both the spirit and <br />28 letter of the Mined Land Reclamation Act and its attending regulations, should <br />z9 be viewed in a similar good light. <br />30 <br />31 Unfortunately, while the Office and Varra are seemingly able to resolve the <br />32 legitimate concerns at play on this site, even when the resolution is not <br />33 necessarily embraced by or beneficial to Varra, the City of Boulcler remains <br />34 firmly opposed to the actions of both. In response, the City's representatives <br />3s appear to be manufacturing counterfeit arguments to advancr: foregone <br />36 conclusions, lacking any underlying scientific foundation, and seemingly void of <br />37 applied experience with affected lands of this nature. <br />38 <br />39 The confusion such arguments tend to inspire may only serve in the end to <br />ao subvert and weaken what even the Office agrees is a reasoned approach to <br />al the problems encountered at the Jenkins Site.
