This is the area that was <br />discussed during the on-site meeting of May 18, 1995 with the Division, Sun Coal Company, <br />and the landowner present. Based on the on-site discussions, and the need to finalize the <br />reclamation obligations at the former facilities and tipple area, Sun Coal is submitting this <br />revision. In short, the revision proposes the reconstruction of a drainageway (or pond as the <br />landowner describes it) through removal of gravel base placed in the area during the <br />wnstruction of the tipple and loadout area. Please note that the gravel removed will not be <br />sold or disposed of off-site, it will be used as backfill, berm and road base material <br />immediately adjacent to the removal site. Further, Sun Coal does not wish the reconstruction <br />to be construed as the construction of a pond as defined by CSCMRA. The excavation will <br />not have any embankment or any of the structural features of a sediment pond or embankment, <br />it will not impound water, and will be open to ground and surface water flow at both ends. <br />If we can assist in the expeditious processing of the revision in any way please contact me or <br />Bryan Archer. <br />Sin, <br />~~ / <br />Michael S.
