I have the <br />following remaining comment. <br />6. BRL indicates that drill holes DH-42, DH-52, DH-~4, and DH-5~ were destroyed by <br />construction activities and access to the wells was destroyed. This does not preclude the need for <br />properly abandoning and permanently sealing these underground openings. Further, it cannot be <br />assumed that the entire completion interval of these wells was destroyed. Abandonment reports <br />are required. My recommendation is to consider enforcement actions for improperly sealing <br />these drill holes (DH-42, DH-52, DH-54, and DH-55) and for failure to submit proof of <br />compliance in accordance with Rule 4.07.3. BRL indicates that they will submit abandonment <br />reports for drill holes DH- l3, DH-34B, and DH-57a. This portion of their response is acceptable. <br />c: Sandy Brown <br />
