Long <br />2130 5. 96th Street Division Director <br />Broomfield, CO 80020 <br />Re: Notice of Consideration by the Mined Land Reclamation Board, Jenkins Pit, File No. <br />M-77-393 <br />Dear Mr. Varra: <br />On April 21, 1995, the Division received written comments from the C:~ty of Boulder <br />regarding the technical revision to the Jenkins Pit permit submitted by Varra Companies <br />on April 5, 1995. I will be forwarding a copy of the City of Boulders comments, along <br />with the Division's responses, to you under separate cover. In the 1Lpri1 21, 1995 <br />correspondence the City of Boulder has demanded a hearing as to whether Varra Companies <br />April 5, 1995 submittal should be considered as a amendment to the permit, rather than <br />a technical revision. <br />Rule 2.5 of the Mineral Rules and Regulations provides a mechanism to terminate <br />controversies or to remove uncertainties as to the applicability of any statutory <br />provision of or any rule or order of the Board made pursuant to the Mined Land <br />Reclamation Act. ~ The City of Boulder's concern as to whether the April 5, 1995 <br />submittal is a technical revision or an amendment has been scheduled for consideration <br />by the Board, under Rule 2.5, at their May 24-25, 1995 meeting. The Board meeting will <br />be held, beginning at 9:00 a.m. each day, in room 318, Centennial Building, 1313 Sherman <br />Street, Denver, Colorado. <br />In a separate matter, the decision date for the technical revision is May 5, 1995. <br />Since submittal of a map showing stockpile locations is a integral component of the <br />revision, and since some time will be required for preparation of the map once grading <br />is completed, please provide the Division with a written waiver of your right to a May <br />5, 1995 decision date.
