During initial review of the application, a number of adequacy issues
were identified. The concerns are as follows:
1. The revised permit page designating the location of the records should include
the mine name and reference the mine records rather than Sun Coal Company's
office files. The zip code and telephone number of Mr. Ellison's office should be
included.
2. Sun Coal Company submitted a revised permit page 162 which stated "At the
termination of the lease, the coal recovery tunnel will be left for Eilts." The
Division has determined that revision of page 338 rather than page 162 would be
more appropriate. That page provides information on haul road and facilities
area reclamation. Sun Coal should revise page 338 to specifically address
whether each facility or structure will be removed or retained, not limited to the
reclaim tunnel. All facilities and structures should be addressed in this section.
3. Sun Coal Company submitted a proposed public notice with the application. A
minor revision is not subject to the hearing and notice requirements of Rule
2.07.3.
