Lochhead <br />E~eculire Director <br />RE: DMG Recommendation for Approval, ~+i<6aei s. ~°nb <br />Dieision Dneclor <br />Pre-Hearing Conference and Formal Public Hearing. <br />Dear Party: <br />On 10/19/98, DMG issued its recommendation to approve, with conditions, the Tozer Pit <br />amendment application. DMG recommendation for conditional approval is based upon its <br />finding that the operator has demonstrated compliance with the minimum requirements of <br />C.R.S. 34-32.5-115(4). The condition for DMG approval recommendation is as follows: <br />Operations may not affect BLM administered lands until DMG receives notice which <br />verifies that the BLM has granted right of entry to Montezuma County for the BLM <br />administered lands described within the Tozer Pit amendment application. <br />As a reminder to DMG's previous 9/21 /98 notification to the parties, DMG has scheduled <br />the application for Formal Public Hearing before the Colorado Mined Land Reclamation <br />Board for consideration of application. The hearing will occur during the November 18 - <br />19, 1998, Board meeting at 1313 Sherman Street, Room 318, Denver, Colorado, <br />commencing at 9:00 a.m. or as soon thereafter as the matter can be considered. <br />The Pre-Hearing Conference, originally scheduled for 10/30/98, has been rescheduled for <br />November 3, 1998. The Pre-Hearing Conference has been rescheduled for 1 1 /3/98, from <br />9:00 a.m. through 10:00 a.m., at the DMG Durango Office, 484 Turner Drive, Building F, <br />Suite 101, Durango, Colorado.
