Cottony <br />Division Director <br />Natural Resource Trustee <br />The Division has reviewed the technical revision application referenced above, and requests that the following items <br />be clarified and/or addressed prior to the Mined Land Reclamation Boazd Ordered decision date for the technical <br />revision of April 13, 2007. <br />The Boazd Order required that parties to the February 14, 2007 hearing on this permit be provided copies of <br />the technical revision; please provide proof that this was done. <br />2. ERO Resources Corporation, whose monitoring well plan forms the substance of the technical revision, <br />recommends that the depth to ground water continue to be measured quarterly in the three proposed wells <br />after mining activities have commenced. Please commit to this as an enforceable permit condition. The <br />Operator will have the ability to request cessation of the monitoring down the line, for good cause shown and <br />subject to Division review and approval. <br />3. The ERO monitoring well plan states that after five quarterly measwements, a report will be prepared <br />_ _ discussing the results. The Division will require_that this report define,.for division review and approval, the. <br />range of acceptable water table elevations in the three wells, and what water table elevations would indicate <br />that the mining operation may be having an adverse impact. Acceptable water table elevations are to be <br />reported in each annual reclamation report. Excursions from the acceptable elevations must be reported to the <br />Division immediately (within five working days; see rule 3.1.7(9)), and must be followed within one week by <br />submittal of a remedial action plan or proof that the excursion(s) aze not mining related, for Division review <br />and approval. <br />If you have any questions, please contact me at 303-866-4063. <br />Sincer "1, <br />1~ .~`_~. <br />Allen C.
