Cattany <br />Division Director <br />Nawral Resource Trustee <br />TO: Joe Dudash <br />FROM: Mike Boulay <br />DATE: November 23, 2004 <br />SUBJECT: Bowie No. 2 Mine, Permit No. C-96-083, Technical Revision No. 35 <br />I have reviewed BRL's responses to items I-4 contained in their adequacy response letter for <br />Technical Revision No. 35 regarding ground water aspects of the proposed B seam mine plan. <br />Al! of their responses are acceptable; however I do have remaining questions. I believe that my <br />questions on original comments 1 through 4 can be resolved without additional comments to <br />BRL. <br />Response accepted. <br />2. Response accepted. The Division agrees with BRL's approach to hydrologic monitoring <br />It is unclear from their response whether or not they are intending to mine the lower B- <br />Seam. <br />3. Response accepted. Does BRL regularly submit abandonment reports for abandoned or <br />'reclaimed monitoring well locations? <br />4. Response accepted (see comment 2 above). Does BRL intend to mine in areas where the <br />interburden between the upper and lower B Seam is in excess of 35 feet? If so, then we <br />will accept their proposed monitoring approach and ground water monitoring will be <br />required in both seams. <br />I have also reviewed your e-mail memo dated November 22, 2004 regarding your meeting <br />with the USDA Forest Service and BRL, and the Forest Service's concern about the springs and <br />ponds in the Sheep Corral Gulch area. As shown on Map 23, the USDA Forest Service has <br />numerous water rights in the Sheep Corral Gulch area.
