Lochhead <br />Eeecunve Dvec~ur <br />M¢hael & Lonp <br />Division Direanr <br />I have reviewed the revegetation/posunine landuse aspects of the proposed revision, and have <br />identified only one potential concern (see below). Apparently, primary changes to the <br />reclamation plan would include excavation of a'/ acre "upland disposal site" upslope from the <br />loadout, where coal and demolition debris would be buried, and allowance for an alternative <br />(commercial/recreation) postmine landuse. Reclamation of both the existing disturbance and the <br />disposal site would be to AOC, with current reclamation standards in effect, in the event that the <br />proposed alternative land use is not implemented. Topsoil would be salvaged from the proposed <br />disposal site, with a minimum of 1 foot of topsoil replaced, and a total cover thickness of four <br />feet of suitable soil replaced over disposed materials. With respect to revegetation, the proposed <br />disposal plan meets the applicable requirements of Rule 4.l 1.4. I assume that you will review <br />the plan for compliance with hydrologic requirements. <br />Because the disposal site would entail minor expansion of the permit area, and disturbance <br />within an area not previously approved for disturbance, the operator would need to provide <br />documentation regarding the potential for impacts to threatened or endangered species of plants <br />or animals, pursuant to Rule ?.04.10(5) and 2.04.11(4). Such documentation may be included in <br />sections of the current penni[ application which 1 did not receive. If you would like me to <br />review those sections, either FAX [hem over, or remind me to take a look at the permit when I'm <br />in Denver next week. <br />
