Box 440 <br />Rapid City, SD 57709-0440 <br />Re: Munroe Gypsum Quarry, Permit No. H-77-002HR, Receipt of 110(2) to 112 <br />Reclamation Permit Conversion Application Package <br />Dear Mr. Barton: <br />On October 18, 1995, the Division of Minerals and Geology reviewed the first <br />conversion application received for the Munroe Gypsum Quarry and found it to be <br />inadequate for technical review due to an improper form being submitted, Exhibit <br />R and the Affidavit of Posting Notice were not enclosed. On October 27, 1995, <br />the Division received your withdrawal request of the October 18th application <br />packages (these packages are enclosed as you instructed - one copy has been <br />retained by the Div ieion for our records) and received the new conversion <br />application for the Munroe Gypsum Quarry. Preliminary review of the replacement <br />application packages received determined that the following items must be <br />received before the application can be considered as being submitted and <br />technical review can begin: <br />EXHIBIT R - Proof of Filino with County Clerk and Recorder - Rule 6.4.18: <br />Provide an affidavit or receipt indicating the date on which the <br />application was placed with the local County Clerk and Recorder. The <br />receipt that was received with the application package indicated the date <br />that the application was mailed to the Clerk and Recorder, not the date <br />that it was received by the Clerk and Recorder. <br />Rule 1.6.2(11 lb) - Affidavit of Postine Notice at the Location of Mine <br />Site: You must post notices at the location of the proposed mine site, of <br />sufficient size and number to clearly identify the site as the location of <br />a mining operation that is being converted to a larger operation. Giving <br />your name, address, and phone number, and stating that you have submitted <br />an application to convert your mining permit from a 110(2) Limited Impact <br />operation to a 112 Regular Permit operation with the Colorado Mined Land <br />Reclamation Board. Your notice must also state that anyone wishing to <br />comment on the application may view the application at the County Clerk <br />and Recorder's Office and should send comments prior to the end of the <br />public comment period to the Colorado Mined Land Reclamation Division, <br />Room 215, 1313 Sherman St, Denver, Colorado 80203. <br />A sample notice is enclosed for your use. <br />After posting the notice you must provide a signed affidavit that eu ch <br />notice has been posted according to the provisions of this Rule and submit <br />the affidavit to the Division. <br />
