M-87-171), a gravel quarry located within the city for which the <br />operator Kiewit Western Co. is beginning operations. While the quarry will be dry mined above <br />the ground water table, water will be required for gravel washing, dust suppression, concrete <br />and asphalt production, equipment washing, and irrigation for site reclamation. The agreement <br />between the City of Fountain and Kiewit Western Co. is for a term not to exceed ten years. <br />Water will be diverted directly out of Fountain Creek at the location of the existing <br />diversion dam of the Owen and Hall Ditch in section 20 and pumped approximately 1 mile <br />northwest to the quarry, which will be located mainly in section 18. Diversions would occur at a <br />maximum rate of 2 cfs, and would total up to 300 acre-feet annually. All diversions will be <br />considered to be consumed. <br />Depletions to Fountain Creek will be replaced using excess replacement water available <br />from the City of Fountain's previously decreed augmentation plans that cover pumping of its <br />existing alluvial wells. The City's Fountain Mutual irrigation Company shares, Womack Ditch <br />rights, and Fry-Ark supplies are decreed as sources of augmentation water in case nos. W-4396 <br />and 85CW 110. Except for rare occasions, these available augmentation sources exceed the <br />replacement requirements of the City's existing municipal wells. <br />The State and Division Engineers have reviewed the plan and the adequacy of each <br />source of water provided for use as augmentation water, including, where necessary, the <br />historical consumptive use of each water right, and return flows from diversion of waters <br />imported into the Arkansas River Basin or other fully consumable waters proposed for use as <br />augmentation water. In accordance with Section 25-8-202(7), C.R.S. and Senate Bill 89-181 <br />Rules and Regulations adopted on February 4, 1992, the State Engineer has determined that <br />subject to the terms and conditions below, the replacement supply is of a quality to meet the <br />requirements of use to senior appropriators. <br />This substitute water supply plan is hereby approved pursuant to Section 37-80-120, <br />C.R.S., subject to the following conditions: <br />IJY~'' ~ <br />
