E C L A M A 7 1 0 N <br />MINING•SAFETY <br />Bill Owens <br />Guvemor <br />Greg E. bW lcher <br />E.eculwr Duecmr <br />Michael B. long <br />Division Director <br />On January 18, 2000, the Division of Minerals and Geology received American Soda, L.L.P.'s Check No. <br />6597, in the amount of $100.00, along with a copy of Page 1 of a Financial Wartanty/Check for Deposit in <br />State Treasury form and a brief letter from you regarding the bond that was submitted to the Bureau of Land <br />Management. The Division requests that American Soda, L.L.P. please submit the following documents so <br />that the Division can process the $100.00 received as a reclamation bond: <br />Financial Warranty/Check for Deposit in State Treasury Form: The Division requires <br />the entire properly executed signed and notarized original Financial Warranty document, to <br />support the $100.00 check as a cash bond. I have enclosed a new form to be executed by <br />American Soda, L.L.P. and signed by an authorized person or persons for American Soda, <br />L.L.P. <br />2. American Soda, L.L.P. must provide documentation that the bond has been posted and <br />accepted by the Bureau of Land Management (BLM). This documentation should be a <br />document signed by Bureau of Land Management personnel showing the amount of bond <br />posted with them and the date when it was posted and accepted. Also, the Division would <br />like to know how much the amount of the BLM Lease Bond is. <br />3. The Division has reviewed the statement in your letter dated January 15, 2000, that <br />American Soda would not request bond release from BLM without prior CDMG approval. <br />This statement only partially satisfies the requirements of Rule 4.2.1(8). To meet the <br />requiremems of Rule 4.2.1(8) please provide the following statement on American Soda <br />letterhead and signed by a person authorized to bind the Company to the commitments <br />contained therein: <br />(n the event that the Bureau of Land Management BLM) makes a decision to reduce or <br />release the Financial Warranty held for the Yankee Gulch Sodium Minerals Project, <br />American Soda (the Operator) or their successor will post an acceptable replacement <br />Warranty with the Colorado Mined Land Reclamation Board (Board) prior to any release or <br />reduction action by the BLM. The replacement Financial Warranty posted with the Board <br />will be in an amount equivalent to the amount to be released by BLM unless the Board <br />
