Eon1; <br /> <br />FROM: Allen Sorenson <br />/~~~ D iv i~~on Director <br />RE: Petition for Reconsideration, Varra Companies/Frontier <br />Materials, Jenk ins Site, Technical Revisi on TR-002, Permit No. <br />M-77-393 <br />On June 13, 1995, the Division received a petition from the City of <br />Boulder requesting that the Board reconsider the Declaratory Order issued <br />May 25, 1995 involving the above captioned technical revision. The <br />petition was received subsequent to the June Board mailing, so it is being <br />provided for your review now. <br />In accordance with Rule 2.9, the Board may act on the petiti~~n in one of <br />three different ways: <br />1. The Board may grant or deny the petition based solely on the written <br />submittal; <br />2. the Board may, in its discretion, grant the petitioner an <br />opportunity to present oral arguments; <br />3. if no action is taken on the petition, it shall be deemed denied on <br />the sixtieth day following receipt of the petition (August 12, <br />1995). <br />The Division has scheduled this matter for the Boards consider~ltion during <br />the July, 1995 meeting so that the pleasure of the Board, as it regards <br />the above listed options, can be determined. The interested parties have <br />been notified of the Board's pending consideration so that they can be <br />represented in the event that ogtion no. 2 listed above is selaacted by the <br />Board. <br />C:\WPS1\)ENKINS.PiJ <br />
