The swap will involve land to be disturbed
following Permit Revision No. 7 approval. ward speculates that the
land swap will close on April 29, 1997, and Chat there do not
appear to be any problems that would delay the closing. If the
swap occurs, then the Sylvester Gulch expansion (PR07) would not
involve any Forest Service land.
Ward and I agreed that we should attach a stipulation to any
proposed decision issued by DMG in the near future that requires
Mountain Coal Co. to submit either proof of land ownership pursuant
to the swap, or obtain Forest Service concurrence prior to
disturbance of lands which are now managed by the Forest Service.
I informed Christine Johnston of this decision this morning.
