Cattany <br />Division Director <br />Natural Resource Trustee <br />On December 26, 2002 the Division of Minerals and Geology (Division) approved a Surety Increase (SI-Ol) resu3ting <br />from observations made during an inspection of the site conducted on October 9, 2002. <br />In a letter dated December 30, 2002; from the Division, White River Aggregates was notified of the increased <br />estimated liability amount from $5,000, to $30,222, an increase of $25,222. The Division has not yet received the <br />additional bond. <br />Rule 4.2.1 (2) of the Construction Materials Rules and Regulations states that In the event that the Office or Board <br />determines that the Financial Warranty (currently held foc a permit) is insufficient to perform reclamation, the <br />Permittee shall have up to sixty (60) days to post additional Financial Warranty from the date of written notice from <br />the Office or Board of such insufficiency. Therefore the additional bond amount of $25,222.00 was due on February <br />28, 2003. <br />If you have not already done so, please submit an additional bond in the amount of $25,222.00 for the White River Sand <br />and Gravel Pit. The deadline for the above corrective action is set for May 5, 2004.
