Dept. of t`latural Resources <br />Colorado Yampa Coal Company (CYCC) is submitting the following informa- <br />tion in response to the CMLRD's Midterm Permit Review letter dated <br />February 26, 1985. <br />IX. Vegetation - Rules 2.04.10, 2.05.4(2)(e), 4.15 <br />1. As noted in the Division's October review letter, a revision has <br />been approved for using a wood chip mulch instead of an annual <br />cereal grain. The revision did not specify the type and rate of <br />mulch which would be applied on areas reclaimed with topsoil from <br />long-term stockpiles (which contain topsoil salvaged prior to roto- <br />clear use and thus, do not contain the wood chip mulch). A plan for <br />mulching (if other than the originally approved annual grain cover) <br />should be submitted for non-rotoclear topsoil areas. <br />RESPONSE: <br />Examination of the original October 13, 1981 submittal to the CMLRD <br />and your response dated December 4, 1981 clearly indicates that the <br />request made by CYCC and approved by the CMLRD was that CYCC would <br />discontinue mulching. The request and approval were not conditional <br />upon the substitution of a wood chip mulch for an annual grain <br />mulch. The revision did in fact specify the soil stabilizing prac- <br />tices to be used by CYCC on all reclaimed areas and not the areas <br />rotocleared as suggested by the CMLRD. Our original revision was <br />based upon a combination of practices which have been used, in- <br />spected and approved by the Division since the fall of 1981. <br />
