The roads aze identified as exempt from the rule (see page 78, line 23). No <br />designs were submitted for review. As we discussed, there may be haul roads to spoil storage <br />piles, topsoil storage piles, etc., that aze not in the pit or disturbed area. The term "road" does not <br />include routes of travel within or adjacent to the immediate mining pit or within spoil or coal <br />mine waste disposal areas [Rule 1.04(111)]. The West Taylor Fill, the East Taylor Fill, and the <br />Section 16 temporary fill all appeaz to be exempt of road design (see Map 23A, 6/9/06). In <br />addition, routes to the topsoil storage areas would also be exempt (see Map 28B, 6/28/06). <br />However, the haul road for topsoil from the footprint of the west fill may not be within or <br />adjacent to the immediate mining pit, and this haul road might require design. There are likely to <br />be access roads to sedimentation ponds. These designs need to be submitted in accordance with <br />Rule 4.03.2. A suggest request of the applicant is: Please include a haul road design for <br />hauling of topsoil from the west excess spoil area to the topsoil storage area, and for access <br />road designs to sedimentation ponds (Rule 4.03). <br />Rule 4.06.3 -Diversions. Diversions (interceptor ditches and post-mining drainages) are located <br />in plan view on Map 41A. Profiles are located on Map 33B. Text is on page 78. Designs for these <br />features are reported as presented in Exhibit 7, Item 20 (page 78, lines 34 and 35). The Colowyo <br />letter of June 30, 2006 states that Exhibit 7, Item 20, is to be supplied under separate cover. <br />Exhibit 7, Item 20, was found in Vohune 2F. Presented therein aze SEDCAD runs for Ponds 21, <br />28, 29, and West Taylor (the table of contents is in error). <br />You have asked Kent to review the SEDCAD runs, but I offer my concerns from a preliminary <br />review of the SEDCAD run for Pond 29. Reference the SEDCAD run for Pond 29, Q10. Two <br />subwatersheds are identified. Subwatershed #1 was assigned a curve number of 91, but is <br />described as forest with heavy ground litter (page 10). The number is probably right, the <br />description probably in error. Subwatershed #1 (interpreted as the reclaimed disturbed area), in a <br />Office of Office of <br />Mined Land Reclamation AQive and InaRive Mines <br />
