First St. Room 105 Executive Direcor <br />Trinidad Colorado 81082 Ronald w. catlany <br />Division Director <br />Natural Resource Trustee <br />RE: Bond Release Objection, Lorencito Mine, #C-96-084 <br />Mr. Cordova: <br />The Division of Minerals and Geology received your request for a public hearing concerning the <br />legal publication regarding a bond release request for the Lorencito Canyon Mine. <br />At this time, the Division has not received an application for bond release at this site. We <br />believe the operator is publishing the notice to meet the requirements of 3.03.2(1) of our Rules. <br />Your office should also receive a written notice directly in accordance with Rule 3.03.2(1). We <br />anticipate receiving an application within a few weeks. A copy of that application will also be <br />filed at the Las Animas County Courthouse. You may want to review the application for specific <br />details regarding the request for bond release. Following the public notice under Rule 3.03.2(1), <br />commentors or objectors are afforded an informal conference under Rule 3.03.2(4)(a)-(e). The <br />purpose of this informal conference is to provide an opportunity to resolve disagreements prior to <br />a proposed decision by the Division and therefore potentially avoid an adjudicatory hearing <br />pursuant to Rule 3.03.2(6). <br />Please also be advised that any applicant for bond release must always provide documentation <br />of reclamation accomplished in accordance with the approved plan and must successful pass an <br />on-the-ground inspection in accordance with Rule 3.03.2(2) prior to any bond release decision <br />by the Division.
