Simpson <br />Stale Engineer <br />RE: Cleaz Creek County, Empire Pit Substitute Water Supply Plan <br />MLRD M77534 <br />NWl/4 SWl/4 Section 29, T3S, R74W, 6TH P.M. <br />Water Division 1, Water District 7 <br />Deaz Mr. Mazquez: <br />This letter is in response to your application for a substitute water supply plan for <br />the Empire Gravel Pit in accordance with Section 37-80-120, C.RS. (1991). The <br />required fees of $350.00 for the substitute water supply plan and $60.00 for the well <br />permit application have been submitted. <br />The anticipated net depletion for this plan is 13.16 acre-feet per year for the 4.5 <br />acres of lake surface exposed after December 31, 1980. According to information <br />submitted, another 2.6 acres of lake surface was exposed prior to January 1, 1981. The <br />proposed plan does not provide for replacement of the depletions from this area. <br />You have provided a monthly breakdown of the annual depletion totalling 7.14 <br />acre-feet of evaporative loss, 4.41 acre-feet of water in the product, 0.70 acre-feet of <br />water used for washing, and 0.90 acre-feet of water used for dust suppression. <br />The proposed source of replacement is from 40 acre-feet of City of Golden water <br />decreed in Case No. 83CW361. According to a lease agreement entered into on October <br />5, 1992, the applicant has up to 40 acre-feet of water available for replacement of <br />mining losses at Reservoir Site No. 1. The 40 acre-feet of replacement water shall be <br />from those sources set forth in the decree entered in Case No. 83CW361 in the Division <br />1 Water Court, as may be specified from time to time by Golden as long as no injury is <br />incurred by other diverters. <br />
