Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology has reviewed the sediment pond inspection reports for <br />the 1st through 3rd quarters of 2004 submitted by Greg Lewicki and Associates for the Rimrock <br />mine. <br />The reports comply with the requirements of Rule 4.05.6(13) for inspection of sediment ponds <br />at coal mining sites. Generally, the pond holds water only for limited periods after storm runoff <br />events. Adequate sediment and water storage capacity, spillway function, and embankment <br />stability was noted. Mr. Lewicki noted in the first quarter that a potential rodent problem on the <br />embankment did not appear to have materialized. Color photographs of the pond and <br />surrounding area were included in the third quarter report. Based on the independent <br />observations during DMG field inspections, we concur with the observations as noted. <br />We have no questions regarding these reports.
