To date, the Division has been unable to complete an amendment to the <br />permit to authorize this new outfall. Under the Colorado Water Quality Control Act, if so requested by the <br />permittee, the Division is obligated to issue a temporary permit when 180 days has elapsed from the date of receipt <br />of application without a permanent permit being issued. By telephone call on August 8, 2000, you requested that <br />authorization for this new outfdl be extended. On this basis, the Division is authorizing this new outfall 008 via <br />this letter, subject to the cotditions in this letter. <br />Discharge from this new outfall may consist of mire pit water and/or surface runoff after treatment in a settling <br />potd wide 7.486 acre-feet of desigtted storage capacity. The outfall of the pond goes ro a drainage that is tributary <br />-- - to Calamity Draw. ' <br />The Division has determined that dte etlluent is similar in pollutants and characteristics to the effluent from <br />currently authorized ouffall 007. On this basis, the effluent from new outfa11008 shall meet the effluent limitations <br />found in Part I.A.1.(c) and the monitoring requirements found in Part I.B.1.(b) of the currently effective permit. <br />Whole effluent toxicity (WET) testing shall be required on a quarterly basis. The Burden of Proof Requirements <br />found in Part I.A,1.(d) of the permit apply to this new outfall with the same conditions applicable to existing outfall <br />007. <br />Reporting of this discharge shall be quarterly, as with the reporting of discharge from other currently authorized <br />outfalls under this permit. We request that you photocopy the appropriate discharge monitoring reports (DMRs) <br />for outfa11007 and rhatlge the outfall number to '008' for use in reporting for this new outfa110t)8 until such time <br />as the outfatl has been permarently authorized and preprinted DMRs have been given to you. Please prominently <br />indicate on the upper portion of the tare of the form that this report is for a period of ~~ry <br />
