Box 459 <br />Florence, CO 81226 <br />Re: Raton Creek Mine <br />Quarterly Sediment Pond Inspection <br />Certification of Quarterly Inspection <br />Dear George: <br />On December 3l, 2002, the sediment control pond at Raton Creek was inspected for structural integrity, <br />erosion, hazardous conditions, and to identify required maintenance. The inspection also satisfies Rule <br />4.05.9 (13) of the Colorado Mined Land Reclamation Boazd for Coal Mining. <br />To the best of my knowledge, based upon my field observations and investigations, as detailed in the <br />attached inspections report, the referenced pond is being maintained in conformance with prudent, state-of- <br />the-art earthen embankment construction. [[ is recommended that a survey be conducted to determine if, <br />due to sediment accumulation, pond capacity complies with design requirements.
