Box 1330 <br />Rifle, Colorado 81650 <br />RE: UNDERGROUND INJECTION CONTROL (iJIC) <br />Class III Solution Mining Well <br />Final Area Permit <br />EPA Area Permit C03870-00000 <br />Rio Blanco County, Colorado <br />Dear Mr. Day: <br />The Environmental Protection Agency (EPA) has reviewed the comments received on the <br />Draft Permit for the Rock School Lease Class III Sodium Minerals Project. The agency has <br />determined that the Permit for the Rock School Lease Project can be issued with some <br />modifications. EPA has prepared an Addendum to the Statement of Basis and Response to <br />Comments (Addendum). This Addendum outlines the Region's rationale for modifying the <br />Permit. It also provides clarification with regards to comments. The Final Class III Solution <br />Mining Well Area Permit for the construction and operation of solution mining wells for the Rock <br />School Lease Project, Rio Blanco County, Colorado is enclosed. Also enclosed is a copy of the <br />Addendum which references AmerAlia, Inc. <br />The EPA procedures for issuing UIC permits are described in the Code of Federal <br />Regulations (CFR) Title 40, Part 124 (40 CFR § 124}. These procedures are provided to allow <br />the public to have an opportunity to comment on the proposed Permit action. <br />Please be aware that it is necessary to delay the Effective Date of the Final Permit for <br />thirty (30) days. This delay is required by 40 CFR § 124.15(b) to allow for potential appeal of the <br />Final Permit decision. <br />~Pdnted on Recycled Paper <br />
