LOng <br />Division Director <br />Today I spoke with Anne Ihlenfeldt, of the Colorado Department of Health, <br />Water Quality Control Division. I asked if they intend to take an enforcement <br />action against Somerset Mining Co. for the effluent limitation problems at the <br />Mine Water Treatment Pond (Sanborn Mine; NPDES outfill 011). She stated that <br />the Department of Health will issue a "letter o1' significant noncompliance", <br />and wait for the third DMR (1st quarter 1993). It is my understanding that a <br />third reported effluent exceedance will result 'in an enforcement action being <br />issued by DOH. She will copy us with the DOH correspondence. <br />Anne indicated that they wiii not use our sampl~a information from the 2/23/93 <br />inspection.
