Walker <br />CDMG C-1981-019, CDPHE CO-0045161 <br />Review of Inspection and Correspondence <br />March 8, 2005 <br />DISCUSSION: Jeff Coombe (Coombe) returned, this date, a telephone call by Byron G. Walker <br />(Walker). There were four subject topics discussed. <br />During the 14 February 2005 Division of Minerals and Geology (Division) inspection of the <br />Colowyo Coal Mine site, Permit C-1981-019, Walker noted an obstruction to free flow from the <br />measuring flume at CDPS discharge point 003A (Stoker Loadout Pond). Walker called Coombe with <br />regard to the CDPHE permit requirement with regazd to flow measuring devices (Page 8, Paragraph <br />5). Coombe believes that any regulatory review and action over the measuring device and the <br />requirement to monitor and report flows would (primacy) be with CDPHE. Coombe asked Walker to <br />re-inspect the device at the next regular inspection, and advise him if the condition had been <br />corrected. Coombe asked Walker for a copy of the inspection report (Walker will e-mail a copy). <br />The loss of TSS results for February samples taken by Colowyo Coal Company (Colowyo) due to <br />laboratory error at discharge points OOIA (Streeter Pond) and 003A (Gossard Loadout) was <br />discussed. Coombe again though that CDPHE has j urisdiction over the monitoring for and reporting <br />of this parameter. Coombe had been in telephone communication with Colowyo, and had informally <br />advised Colowyo by telephone that though technically a violation, no enforcement action was likely, <br />due to Colowyo`s response to the situation. <br />Coombe asked Walker to start sending copies of Division inspection reports to him. Walker will for <br />Colowyo.
