Park County Road & Bridge Dept, ("operator") desires to con- <br />duct a min;ng operation known as See Attachment "A_ _____ <br />for the purpose of extracting sand and eravel <br />3. Cn March "iQ__`, 199L, the Mined land Reclamation <br />9oard ("the Doard") approved operator's application for <br />this permit, fixed the amount of bond and directed that <br />this permit be issued upon the filing with the .Mined Land <br />Reclamation Division ("the division") of bond in the amount <br />so fixed together with surety or sureties thereon in form <br />• and substance. approved by the Division, and such bond and <br />sureties have been so furnished. <br />C. The board on March 30 , 199 made~the following find- <br />ings: <br />1. the application for enis permit complies with the <br />requirements of the Colorado Mined Land Reclamation <br />Actr C.R.S. 1973, 34-32-101 $>`ggq. as amended ("the <br />Act") and with all applicable local, state and federal <br />laws; <br />2. the operation will not adversely affect the stability <br />of any significantr valuable. and permanent man-made <br />structure located within two hundred feet of the affected <br />land, except where there is an agreement between oper- <br />ator and the persons Having an interest in the struc- <br />ture that damage to the structure is to be compensated <br />for by operator; antl <br />3. the proposed mining and reclamation operations can be <br />carried out ;n COnfOrmdnCe with the requirements of <br />the ACt. <br />D. Operator has made a showing satisfactory to the board: <br />(1) that ;t will employ, during and after its underground <br />min;ng and surface operations, procedures reasonably designed <br />to minimizer as much as practicable, environmental disturb- <br />ance from such operations; (2) that it will provide for <br />reclamation of the affected lantls appropriate to the subse- <br />quent beneficial use of such lands; and (3) that, in the <br />event of the failure of its proposed reclamation plan. it <br />will take whdteVer med5Ure5 may be neCe55dry t0 assure the <br />success of reclamation of the lands affected by such oper- <br /> <br />
