LAFARGE <br />NORTH AMERICA <br />Construction Materials <br />August 30, 2004 <br />SEP 9 1 ~~~4 / <br />Erica Crosby <br />Division of Minerals and Geology <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 <br />Division o/Minerals and Geology <br />RE: Lafarge West, Inc., Application No. M-2003-091 <br />Duckworth Pit, Adequacy Response #2 / <br />Dear Erica, <br />Lafarge received the adequacy review from Division of Minerals and Geology (Division) for the <br />Duckworth Pit New 112 Application, File Number M-2003-091. The following responses have <br />been prepared to address the Division's concerns. <br />1. The Division previously questioned storm water runoff drainage that will be detained in <br />the adjacent Cottonwood Pit. <br />The original permit application stated, "...runoff...wil] be detained in the ponds already <br />existing at the previously permitted Cottonwood Pit...." in error. Stormwater at the <br />Duckworth site will flow into the property's dewatering trenches, allowed to settle in the <br />collection areas, and monitored as required by the NPDES permit and Stormwater <br />Management Plan prior to dischazging. The Revised 112 Reclamation Permit Application <br />submitted for the last adequacy review had the erroneous text removed. <br />As previously stated, Lafarge proposes to mine through and relocate the Smith & <br />Emmons Ditch. Lafarge has not yet submitted a notarized agreement between Lafarge <br />and the owner of the Smith & Emmons Ditch to mine through and relocate the structure. <br />Until such agreement is submitted and approved by the Division, Lafarge will need to <br />revise all maps to reflect the approved mining off-set distance from the Smith and <br />Emmons Ditch. If such notarized agreements cannot be achieved during this review <br />period, then a revision to the permit will need to be filed in the future prior to mining <br />closer than the approved mining off-set distance. <br />The Ditch Relocation agreement between Lafarge and the Smith & Emmons Ditch <br />Company has been executed and is attached. <br />3.
