SIMPSON, CHIEF, WATER MANAGEMENT BRANCH <br />SUBJECT: MOUNTAIN MOBILE MIX -CHAMBERS PIT - GARFIELD COUNTY, <br />APPLICATION FOR MINING AND RECLAMATION PERMIT <br />As requested by your office, we have reviewed the application for a gravel <br />pit near Rifle. The report states that water would be obtained from the <br />discharge of the dewatering pump for dust control at the crusher. The <br />applicant must have a well permit to use the pit water to be in compliance <br />with state statutes, CRS 1973, 37-90-137. <br />The applicant should also evaluate the effects of evaporation losses from <br />the 10-acre reclamation pond on the downstream senior water rights at <br />Grand Valley. During dry years, the water rights place calls on junior water <br />rights; therefore, it is obvious that any additional detrimental changes to <br />the exist[ng hydrologic balance could result in injury. Until the applicant <br />has a method to minimize this injury, such as a plan of augmentation, and <br />has obtained a legal source of dust control water, we do not recommend <br />approval of this application. <br />~C- Q <br />Hal D.
