Cattany <br />Division Director <br />Natural Resource Trustee <br />Listed below are adequacy review comments for the H/S Properties Gravel Pit 1 10 (c) Permit Application, File No. M- <br />2007-042. The decision date for this permit application is August 16, 2007. The Division of Reclamation, Mining, and <br />Safety (Division) is required to make a decision by August 16. Therefore, your response to the following adequacy <br />review concerns should be submitted to the Division as loan as possible. <br />1. Please submit a new page 3 of the permit application, including the GENERAL DESCRIPTION (the number of <br />miles and direction from the nearest town and the approximate elevation). <br />2. As required by Rule 1.6.3 (3}, please submit the proof of publication of the public notice circulated in the local <br />newspaper. <br />Rule 6.3.4 Exhibit D -Reclamation Plan <br />3. Section (2) of the Reclamation Plan requires the Applicant to provide an estimate of the actual costs to reclaim the <br />Site based on what it would cost the State of Colorado using an independent contractor to complete reclamation. <br />Please be aware that the Division will also estimate the cost to reclaim the site based on the information submitted <br />in the application and responses to adequacy reviews <br />Rule 6.3.12 Exhibit L- Permanent Man-made Structures <br />4. The submitted mining plan indicates that "the existing bridge across an existing irrigation drainage ditch would be <br />replaced by a 15" culvert." Please supply ownership information regarding the irrigation ditch. If the ditch is not <br />privately owned by H/S Properties, please supply an agreement with the ditch company indicating that it has <br />agreed to the installation of the culvert. <br />5. Section (b) of this rule directs the Applicant to provide an appropriate engineering evaluation that demonstrates <br />that structures for which damage agreements cannot be obtained, shall not be damaged by activities occurring at <br />the mining operation. In lieu of a damage agreement for the Union Pacific Railroad right of way and tracks, the <br />applicant has supplied a statement from Jessica Loveland, P.E. of Ute Engineering and Surveying Company, <br />stating that as long as specific practices are incorporated during site activities, she does not believe that mining on <br />the property will have any impacts on the railroad interest. [n the absence of a datnage agreement, the Division <br />requires a geotechnical stability report related to potential impacts to the nearby permanent man-made structures. <br />Please submit either a damage agreement or the appropriate geotechnical stability report. <br />Office of Office of <br />Mined Land Reclamation Active and Inactive Mines <br />
