The reports are for the fourth quarter and December of 2004. The
fourth quarter SAE, pond and water monitoring reports were previously transmitted to the
DMG.
Central Appalachia Mining, LLC, was advised on November 12~' that a demonstration of
chronic WET occurred during a routine test. Accelerated testing was performed using the
single species found to be more sensitive, (P. promelas). The first accelerated test began
on November 29~' and it passed. The second accelerated test began on December 13,
2004 and it passed. Since two consecutive accelerated tests passed, no pattern of toxicity
was demonstrated. Therefore, the toxicity episode is considered to be ended.
Documentation of the accelerated testing is enclosed.
Sincerely,
~~e~a` `-~'~'
J. E.
