Lemur
Governor
April 3, 1984
Mrs. Leonard Koop
8255 Mustang Place
Colorado Springs, Colorado 80908
RE: R.E. Monks Plant No. 1 - File No. 83-193
Dear Mrs. Koop:
R.E. Monks Construction Company was issued a mining and reclamation permit for
the above captioned operation located on Vollmer Road (as referred to in your
letter received on March 26, 1984) on February 3, 1984. This 1s a sand mining
operation with an associated concrete plant. The permit issued by our
Division regulates the mining and reclamation of a 35 acre area located in the
NEl/4 of Section 5, Township 15 South, Range 65 West of the 6th P.M. The
permit is for the life of the mining operation, estimated by the operator to
be five years. This life of the mine can; however, be modified at a later
time by a request to the Mined Land Reclamation Board.
Enclosed please find a copy of the review letter from the Dl vision of Mater
Resources to our Division concerning the permit application for this
operation. The operator's consultant, in response to this letter, wrote to us
that no ground water was expected to flow into the pond on site. In any case,
our Board approved the following stipulation to the permit for this operation:
"The Mined Land Reclamation Board recommends that all mine operators
check compliance of their mining operation(s) with state water law. If
mining commences without prior compliance with applicable state water
laws, the State Engineer may take enforcement action."
The permit was issued with this stipulation attached. I suggest that you
direct any further questions concerning water rights or water usage on this
site to the Department of Water Resources.
Please feel free to stop by our office 1f you wish to review the permit file
for this operation.
Sincerely,
~' 0
Mark S.
