Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division has reviewed the l l lc permit application and has the following issues that need to be <br />addressed or clarified. <br />1) Although it is appazent, please clarify that no explosives aze going to be used as is required under <br />Rule 6.3.3(P) <br />2) Please find enclosed a photo taken today along the northern edge of the on going activity. <br />According to the maps supplied it appears that there is an intended buffer zone between the mesa <br />edge and the excavation. Staff notes that by scale at the narrowest point it should be <br />approximately 25 feet. There is no point of reference on site but the disturbance appears to be <br />within 15 feet in some areas that should be wider. Please clarify and if necessary adjust maps to <br />correct the discrepancy. <br />3) The Railroad -right of way is within 200 feet of the proposed permit edge. Please note the <br />railroad right of way in Exhibit L. <br />4) Within the Mining Plan please note measures being taken to prevent the accidental spill of <br />materials onto the railroad tracks below. <br />5) Please note in the Mining Plan how permit boundaries will be marked to prevent excavation <br />outside the permit boundaries. Please note that such activities are a violation of the permit and <br />cause for another hearing before the Board. <br />6) Please submit a damage waiver or engineer's statement as required under Rule 6.3.12(c) for the <br />railroad within 200 feet of the proposed permit boundaries. <br />7) The Division has been advised by the AGO Office that more substantive proof of a government <br />contract statement is necessazy for Exhibit K. The City's legal consul has been in conference <br />with the AGO about the possibility of supplying either a copy of some sort of City approval for <br />the excavation or an affidavit affirming the materials are only for the Riverside Parkway Project. <br />8) Please state that the City will request a full release of the Notice of Intent, P-2005-004 for this <br />site as it is now in•elevant upon approval of the permit application. <br />Office of Office of <br />Mined Land Reclamation AQive and Inactive Mines <br />
