Walther <br />Executive Director <br />mrchael B. long <br />Division DFrecmr <br />The Division has received your January 25, 2001 letter of objection to the above referenced application, <br />addressed to the Colorado Mined Land Reclamation Board. <br />In order to avoid issues of ex-pane communication with the Board, the letter will remain on file at the <br />Division offices and any jurisdictional issues raised in the letter will be considered by Division staff <br />during the review period. <br />The application was considered officially submitted for review on January 11, 2001, and Division staff <br />has 90 days to make a decision on whether to approve or deny the application. This 90~' day is referred <br />to as the "decision date". If objections are received and not withdrawn, Division staff makes an approval <br />or denial recommendation, not a decision, and the matter is scheduled for a formal public hearing before <br />the Mined Land Reclamation Board. Unless the review period is extended by the applicant, the hearing <br />must occur within 120 days of the application submittal date. If a final decision on the application is not <br />made by the 120i1' day, the Statute requires that the application be au[omatica/ly approved. <br />If a formal public hearing is scheduled, apre-hearing conference in most cases must also be scheduled. <br />The date of the pre-hearing conference must be no sooner than 7 days after the 90-day decision date and <br />at least 5 working days prior to the Board hearing date. Submittal of statements to the Board by all parties <br />to the process is organized by the pre-hearing conference officer and in most cases must occur within a <br />few days of the date of the pre-hearing conference. As such, you should be prepared to re-submit your <br />written statement to the Board at that time, as instructed by the pre-hearing conference officer. <br />For all parties that submitted timely statements of objection to or in support of the application, the <br />Division will provide written notice of dates, times, and locations of all conferences and hearings.
