SH ELTON, Director <br />County, City, and Town Zoning <br />MEMORANDUM <br />DATE: January 16, 198b <br />T0: Lorimer County Planning Department <br />FROM; David Berry! <br />Pursuant to the requirement of the Colorado Mined Land Reclamation Act* to <br />inform counties and certain municipalities of mining and reclamation permit <br />applications filed with this office, please know that David Bacon/Glenn <br />Southwick, File M-86-007 has filed to conduct sandstone Guarrv <br />mining at NEB SW Sec 26, T6N, R70W, 6th P.M. The applicant proposes <br />to reclaim the site for around cover for wildlife <br />The Mined Land Reclamation Board must deny a permit for any proposed mining <br />operation which would be in violation of zoning, subdivision regulations or <br />any master plan for extraction (See C.R,S. 34-32-115(4)(e)). Similarly, the <br />Board can not grant a permit for anew mining operation if the operator's <br />reclamation plan for an area is inconsistent with an adopted plan by any <br />county, city and county, city, or town unless a prior declaration of intent to <br />change or waive the prohibition is obtained by the applicant from the affected <br />government subdivisions (See C.R.S. 34-32-109(8)). Please return the enclosed <br />form to provide this critical information. <br />The applicant is required to place a copy of the application for public <br />inspection with the Clerk of the county in which the proposed mine is <br />situated. This is intended to provide the application for public review and <br />comment. Please note that it is not intended to be made a part of public <br />record by recording. <br />The Board is tentatively scheduled to consider this application on <br />February 26-27 1986, <br />We appreciate your cooperation in this matter.
